MakerShake is an online directory and community designed to help users discover apps, maker projects, indie tools, experiments, and other digital products and to connect makers with each other and with potential users, collaborators, clients, or investors.

MakerShake may allow users to:

• generate a project profile from a publicly accessible URL;
• edit and publish project profiles;
• add descriptions, images, screenshots, categories, tags, technologies, and creator information;
• appear in MakerShake search results, categories, tags, collections, rankings, and featured areas;
• comment on published projects and reply to comments;
• upvote and share projects;
• save projects to a private collection;
• follow other makers;
• receive in-app notifications;
• exchange direct messages with eligible makers;
• receive inquiries through public or private contact options;
• display availability, collaboration, and funding-status signals;
• access profile and portfolio analytics;
• receive automated or manually prepared website feedback;
• receive an optional private website audit where available;
• purchase subscriptions, additional project slots, visibility, analytics, or other paid features; and
• use other features made available by MakerShake.

Features, limits, prices, and plan availability are described on the MakerShake website and at checkout.

You may use MakerShake only if you are legally capable of entering into a binding agreement.

If you use MakerShake on behalf of a company, client, organization, studio, or other legal entity, you confirm that you have authority to act on its behalf and, where applicable, bind that entity.

You must provide accurate and current information when creating an account, submitting a project, purchasing a plan, claiming a profile, or contacting us.

Some MakerShake features require an account.

You are responsible for:

• protecting your login credentials;
• maintaining accurate account information;
• activity carried out through your account; and
• notifying us promptly if you suspect unauthorized access or misuse.

You must not sell, transfer, share, or misuse your account.

We may restrict, suspend, or terminate accounts that violate these Terms, the Acceptable Use Policy, applicable law, or that create a material legal, technical, security, fraud, abuse, or operational risk.

Where required by law, we will provide information about material account restrictions and available complaint options.

MakerShake allows users to create a starter project profile by submitting a publicly accessible URL.

MakerShake may automatically access and process information available on the submitted website, including:

• project name;
• tagline and description;
• favicon;
• Open Graph image;
• metadata;
• categories;
• tags;
• screenshots;
• pricing information;
• technologies or tools used;
• founder or creator information; and
• other publicly available information relevant to creating the profile.

MakerShake may use automated systems, including artificial-intelligence-based systems, to extract, classify, summarize, rewrite, or generate profile information.

Generated information may be incomplete, inaccurate, outdated, or unsuitable. You are responsible for reviewing and correcting your profile.

By submitting a URL, you confirm that:

• you are authorized to submit the relevant project;
• the submission is lawful;
• use of the relevant information on MakerShake does not violate third-party rights; and
• the submitted website is not private, restricted, confidential, or password-protected unless you are authorized to submit it.

Profiles may generally be edited before and after publication.

Ordinary project profiles may be published without a manual approval queue. However, publication and continued publication are not guaranteed.

MakerShake may automatically or manually review a profile before or after publication.

Every submitted website address is screened automatically before a listing can go live. The screening checks the address itself for deceptive or disguising patterns, confirms that the domain resolves and the destination is reachable, follows redirects to the final landing page, compares the destination against public malware and phishing threat feeds and our blocked-domain list, and classifies the public homepage content against the Acceptable Use Policy. Clear-cut violations are refused at submission; borderline results are published and queued for human review.

Published listings are re-screened periodically for as long as they remain online, and a listing may be re-screened when a user reports it. A listing whose destination becomes unsafe, unlawful, or unreachable may be unpublished automatically and reviewed afterwards.

The number of projects one account can submit within 24 hours is limited to protect the directory from automated and bulk submissions. Screening is automated and imperfect: it can produce both false positives and false negatives, and a passing result is not a security assessment or endorsement of the destination.

We may reject, restrict, unpublish, edit, relabel, or remove profiles that:

• violate these Terms;
• violate the Acceptable Use Policy;
• appear fraudulent or materially misleading;
• infringe third-party rights;
• contain prohibited or unlawful content;
• duplicate another profile;
• link to an unavailable, deceptive, or unsafe destination;
• do not represent a genuine digital product or project;
• manipulate rankings, engagement, search, or discovery; or
• create a material risk for MakerShake, its users, or third parties.

Publication does not constitute verification, certification, endorsement, investment advice, security review, or approval by MakerShake.

Profiles may include:

• project names and descriptions;
• websites and external links;
• title images and Open Graph images;
• screenshots;
• categories and tags;
• technology or “built with” information;
• creator or founder information;
• pricing and availability;
• contact options;
• availability and collaboration badges;
• funding-status signals;
• fundraising notes;
• analytics or engagement information; and
• other profile information supported by MakerShake.

You must keep published information reasonably accurate and current.

You must not materially misrepresent a project's:

• functionality;
• ownership;
• creator;
• security;
• pricing;
• availability;
• users or customers;
• integrations;
• traction;
• revenue;
• awards;
• regulatory status;
• funding status; or
• commercial performance.

The Free plan currently includes:

• one published project profile;
• one title image, which may also be used as the profile's social-sharing image;
• an automatically generated profile from a URL;
• automatically generated SEO title and description;
• profile editing;
• a public directory listing;
• inclusion in MakerShake's internal search;
• one category;
• up to six tags;
• a direct email contact option where enabled;
• a funding-status signal that may be set to “Bootstrapping”, “Open to funding”, or “Actively raising”;
• favicon and Open Graph image checks; and
• other functionality identified on the pricing page as part of the Free plan.

The Free plan does not currently include the paid visibility, analytics, screenshot, contact-form, or other features reserved for paid plans unless expressly stated otherwise.

Free features may be subject to fair-use limits, moderation, technical restrictions, and future changes.

Unless MakerShake expressly makes a separate binding commitment, the existence of a free plan does not guarantee that every free feature or limit will remain unchanged permanently.

The Pro plan currently includes:

• up to three project profiles;
• a title image and up to three additional screenshots per project;
• eligibility for boosted visibility rotation;
• profile-view analytics;
• outbound-click analytics;
• a private contact form;
• message delivery through the maker's in-app inbox, email forwarding, or both depending on settings;
• a funding-status signal;
• an “Available for work” badge;
• an “Available to remix” badge;
• landing-page tips;
• eligibility to purchase additional project slots; and
• other features identified on the pricing or checkout page.

The price, billing interval, included features, and applicable taxes are shown before purchase.

The Pro+ plan currently includes:

• up to ten project profiles;
• a title image and up to six additional screenshots per project;
• the features included in Pro;
• higher visibility rotation within MakerShake;
• priority processing or indexing within MakerShake;
• a highlighted funding-status signal;
• an optional fundraising note;
• eligibility for inclusion in an investor-oriented filter or discovery feature;
• expanded analytics, which may include country, city, device, and referrer information;
• an optional private website audit;
• eligibility to purchase additional project slots; and
• other features identified on the pricing or checkout page.

“Priority indexing” refers only to MakerShake's internal processing and discovery systems.

MakerShake does not control or guarantee indexing, ranking, visibility, or citation by external search engines, social networks, AI systems, or other third parties.

Eligible paid users may purchase additional project slots.

The current price displayed by MakerShake is USD 9 per additional project slot per month, unless a different price is shown at checkout.

Additional project slots:

• require an active eligible subscription;
• renew according to the billing interval shown at checkout;
• may end when the underlying paid plan ends;
• do not independently provide a base-plan entitlement; and
• may be subject to technical or reasonable-use limits.

The binding price and billing interval are those displayed before the purchase is completed.

The pricing page and checkout flow describe the features included in each paid plan at the time of purchase.

MakerShake may improve, replace, modify, or discontinue features.

Where a change materially affects an active paid consumer contract, mandatory rights concerning notice, conformity, termination, price reduction, refund, or other remedies remain unaffected.

Minor design, technical, organizational, security, or operational changes that do not materially reduce the contracted service may be introduced without individual notice.

Profiles may be displayed through:

• the MakerShake homepage;
• internal search;
• categories;
• tags;
• featured rows;
• maker profiles;
• curated collections;
• recently added sections;
• investor-oriented filters;
• recommendation systems;
• popularity or engagement views; and
• other discovery areas.

Principal factors that may affect visibility or placement include:

• relevance to a search, tag, or category;
• selected subscription plan;
• eligibility for paid visibility;
• rotation between eligible projects;
• recency;
• profile completeness;
• profile quality;
• project availability;
• tags and category;
• user engagement;
• saves, follows, upvotes, or other engagement signals;
• moderation status;
• fraud or manipulation signals; and
• editorial or operational decisions.

Paid plans may receive greater visibility than Free profiles.

Paid visibility does not guarantee:

• a particular ranking;
• a particular number of appearances;
• impressions;
• clicks;
• leads;
• customers;
• downloads;
• investors;
• messages;
• sales; or
• any commercial result.

MakerShake may update ranking and rotation methods to improve relevance, quality, safety, fairness, fraud prevention, or operation of the service.

Pro and Pro+ projects may be eligible for featured placement.

Eligibility does not mean that a project will appear continuously or to every visitor.

The number, order, frequency, and duration of appearances may depend on:

• the number of eligible projects;
• the user's browsing or search context;
• the applicable subscription;
• project relevance;
• rotation rules;
• quality and completeness;
• moderation status;
• fraud or abuse signals; and
• technical availability.

Pro+ projects may receive greater rotation weight than Pro projects.

MakerShake may automatically create or suggest titles, descriptions, metadata, and Open Graph information for project profiles.

These features are intended to improve representation within MakerShake and on compatible third-party services.

MakerShake does not guarantee:

• search-engine indexing;
• any external search position;
• AI or LLM visibility;
• inclusion in AI-generated answers;
• a particular social-media preview;
• continued use of metadata by a third party; or
• increased traffic or engagement.

External providers determine whether and how they crawl, index, summarize, rank, or display MakerShake pages.

Free profiles may use a direct email link. This may expose the maker's email address to visitors and automated systems.

Eligible paid profiles may use a private contact form.

Makers may configure private contact-form messages to be:

• delivered to their MakerShake inbox;
• forwarded to a nominated email address; or
• both.

Where email forwarding is enabled, the maker is responsible for keeping the nominated contact address current.

MakerShake may:

• store submissions;
• forward messages;
• use spam and abuse filtering;
• restrict links or attachments;
• restrict senders;
• apply rate limits;
• block malicious submissions; and
• retain messages where reasonably necessary for support, abuse prevention, or legal requirements.

MakerShake does not guarantee that every message will be delivered, read, answered, or lead to any relationship or transaction.

The contact system must not be used for spam, unlawful marketing, harassment, scams, phishing, malware, or other prohibited communications.

Signed-in users may post comments and replies on eligible public project profiles.

Comments are public User Content.

Your public display name, handle, and avatar may appear alongside your comment.

You are responsible for comments you post.

MakerShake may:

• impose comment limits;
• use spam filters;
• restrict replies;
• remove comments;
• disable commenting;
• moderate abusive content; and
• restrict accounts that misuse commenting.

You may delete your own comments where the feature allows it.

Deleted comments may remain temporarily in backups, moderation records, security logs, or evidence where reasonably necessary.

Signed-in users may upvote projects.

Sharing activity or share counts may also be recorded as engagement signals.

Aggregate upvote or share information may:

• be shown publicly;
• contribute to sorting or discovery;
• be used in analytics; and
• be used to identify artificial engagement.

You must not manipulate engagement using:

• multiple accounts;
• bots;
• scripts;
• click farms;
• coordinated manipulation;
• false incentives; or
• other artificial methods.

MakerShake may discount, remove, or recalculate activity that appears artificial.

Signed-in users may save projects to a personal collection.

Your saved-project collection is private to your account.

However, where MakerShake provides a notification to the maker whose project was saved, the notification may show information from your public MakerShake profile.

Aggregate save counts may be used for analytics, ranking, or discovery.

Saving a project:

• does not grant any license;
• does not create any entitlement;
• does not guarantee continued availability of the project.

A saved item may disappear if the project is deleted, removed, unpublished, or otherwise unavailable.

Users may follow other makers.

Following is not confidential.

The followed maker may:

• receive a notification;
• see your public profile;
• see you in a follower list where supported.

Follower and following counts may be displayed publicly.

MakerShake may generate notifications for:

• follows;
• saves;
• comments;
• replies;
• direct messages;
• new projects;
• moderation activity; and
• other relevant account activity.

Notifications are a convenience feature and are not guaranteed to be complete, timely, or permanently retained.

MakerShake provides private one-to-one messaging between eligible users.

Messaging may require a mutual follow or another eligibility condition configured by MakerShake.

If the eligibility condition ends, the conversation may become read-only, restricted, or unavailable for new messages.

Direct messages are private between the participants but are stored on MakerShake's infrastructure.

MakerShake may technically access message content where reasonably necessary to:

• operate the feature;
• investigate technical problems;
• provide support;
• investigate reports;
• prevent fraud or abuse;
• enforce these Terms or the Acceptable Use Policy;
• investigate security incidents; or
• comply with legal obligations.

MakerShake does not routinely read private conversations and does not use private direct-message content for advertising or AI-model training.

You must not use messages for:

• spam;
• unsolicited bulk outreach;
• harassment;
• threats;
• scams;
• phishing;
• malware;
• unlawful marketing;
• hate or violent abuse;
• sexual exploitation;
• unlawful content; or
• other conduct prohibited by the Acceptable Use Policy.

MakerShake may impose message-size limits, rate limits, anti-spam rules, and other technical restrictions.

Messages may be removed or access to messaging restricted in response to violations.

MakerShake does not guarantee indefinite retention, successful delivery, receipt, reading, or response.

MakerShake is not a party to agreements concluded through direct messages.

Eligible makers may display an “Available for work” or similar badge.

The badge indicates openness to inquiries concerning:

• freelance work;
• commissioned apps;
• consulting;
• contracts;
• employment;
• custom development; or
• collaboration.

It does not mean that:

• MakerShake employs the maker;
• MakerShake represents the maker;
• MakerShake verifies qualifications;
• MakerShake recommends the maker;
• the maker will respond;
• MakerShake acts as an employment or recruitment agency; or
• MakerShake is a party to an agreement.

Users are responsible for their own due diligence and for agreeing directly on scope, payment, taxes, confidentiality, intellectual property, warranties, and liability.

MakerShake does not charge a commission on these arrangements unless expressly stated before the relevant transaction or arrangement.

Eligible makers may display an “Available to remix” or similar badge.

The badge indicates openness to discussing:

• adaptations;
• alternate implementations;
• localizations;
• niche versions;
• integrations;
• reimagined versions; or
• similar collaboration.

The badge does not grant:

• a copyright license;
• a software license;
• source-code access;
• trademark rights;
• permission to copy design or content;
• commercial rights; or
• any waiver of intellectual-property rights.

Any right to copy, modify, localize, distribute, license, or commercialize a project must be agreed separately with the relevant rights holder.

Makers may voluntarily display a funding-status signal such as:

• “Bootstrapping”;
• “Open to funding”; or
• “Actively raising”.

Paid plans may provide enhanced presentation, fundraising notes, or inclusion in investor-oriented discovery filters.

Funding information is self-declared.

MakerShake does not independently verify:

• funding status;
• company status;
• fundraising stage;
• valuation;
• round size;
• traction;
• financial information;
• legal eligibility to issue securities; or
• investor suitability.

A funding-status signal or fundraising note:

• does not constitute investment advice;
• does not constitute an offer of securities by MakerShake;
• does not constitute a solicitation by MakerShake;
• does not mean MakerShake recommends an investment;
• does not create an agency relationship; and
• does not make MakerShake a party to any financing discussion or transaction.

Makers are responsible for ensuring that fundraising statements comply with applicable securities, financial-promotion, advertising, and other laws.

Investors and other users are responsible for their own legal, financial, and commercial due diligence.

Users may identify tools, frameworks, models, APIs, services, or technologies used to build their projects.

You must ensure that built-with information is reasonably accurate and does not falsely imply:

• sponsorship;
• certification;
• partnership;
• affiliation; or
• endorsement.

Third-party product names and trademarks remain the property of their respective owners.

Eligible plans may include analytics such as:

• profile views;
• outbound clicks;
• engagement;
• trends;
• referral information;
• approximate geography;
• device information; and
• comparative analytics.

Analytics may be:

• approximate;
• delayed;
• incomplete;
• filtered;
• duplicated;
• affected by privacy tools;
• affected by bots; or
• temporarily unavailable.

MakerShake may filter or exclude:

• bots;
• suspected manipulation;
• internal traffic;
• repeated events;
• spam;
• automated traffic; or
• other activity that MakerShake does not consider meaningful.

Analytics are provided for general informational purposes.

They are not guaranteed to be suitable for:

• accounting;
• advertising attribution;
• investor reporting;
• legal evidence;
• regulatory filings; or
• financial forecasting.

Eligible users may receive automated or manual suggestions relating to:

• clarity;
• positioning;
• copy;
• structure;
• metadata;
• search presentation;
• accessibility;
• calls to action;
• AI or LLM discoverability; and
• general presentation.

These are general informational suggestions.

They are not:

• legal advice;
• tax advice;
• accessibility certification;
• security advice;
• regulatory advice;
• investment advice; or
• professional consulting advice.

MakerShake does not guarantee that implementing a suggestion will improve rankings, conversions, compliance, traffic, revenue, or visibility.

Eligible users may request an optional private website audit.

The audit may cover matters such as:

• presentation;
• clarity;
• usability;
• positioning;
• metadata;
• SEO;
• search visibility;
• AI visibility; and
• related website characteristics.

An audit:

• reflects the website at the time reviewed;
• may use automated tools;
• may contain errors or omissions;
• is not a certification;
• does not replace specialist professional advice; and
• does not guarantee any result.

Unless the user chooses to publish it, the audit is intended to remain private, subject to necessary technical providers and legal obligations.

“User Content” means information or material submitted, uploaded, imported, generated, edited, posted, or otherwise provided by a user through MakerShake.

This includes, where applicable:

• project names;
• descriptions;
• taglines;
• images;
• logos;
• screenshots;
• links;
• categories;
• tags;
• maker information;
• funding information;
• comments;
• replies;
• direct messages;
• contact submissions; and
• other user-supplied content.

You retain any ownership rights that you hold in your User Content.

You remain responsible for your User Content.

By submitting or publishing public User Content, you grant MakerShake a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, format, adapt, display, publish, distribute, and technically process that content as necessary to:

• operate MakerShake;
• create and display profiles;
• generate previews and metadata;
• make content searchable;
• include profiles in discovery systems;
• show social previews;
• promote MakerShake and public listed projects;
• display public profiles on MakerShake-controlled social channels or marketing materials; and
• maintain technical backups and caches.

This license does not transfer ownership.

Private direct messages and private contact-form messages are excluded from this public-content license.

Private content is processed only as necessary to:

• provide the relevant messaging feature;
• transmit messages;
• provide support;
• secure the service;
• prevent abuse; and
• comply with legal obligations.

Private content is not licensed to MakerShake for general promotional or marketing use.

The public-content license ends when the relevant content is removed, except where continued retention is reasonably necessary for backups, legal obligations, security, evidence, or previously created materials that cannot reasonably be withdrawn.

You confirm that:

• you own your User Content or have the necessary permissions;
• you are authorized to submit or manage the relevant project;
• your content does not unlawfully infringe intellectual-property, privacy, publicity, contractual, or other rights;
• your content is not materially misleading;
• you have permission to use submitted logos, screenshots, photographs, quotations, and other protected material; and
• submitting any relevant website URL is lawful.

Projects listed on MakerShake are generally provided by independent third parties.

Unless expressly stated otherwise, MakerShake is not:

• the seller;
• developer;
• licensor;
• employer;
• recruiter;
• contractor;
• investor;
• broker;
• payment processor;
• marketplace seller; or
• support provider for the listed third-party project.

MakerShake does not take a share of transactions between makers and visitors unless a separate service expressly states otherwise.

Any purchase, subscription, employment, commission, remix, investment, licensing arrangement, or other agreement is entered into directly between the relevant parties.

Users should independently assess a third-party project before:

• installing software;
• providing personal data;
• making a payment;
• granting permissions;
• entering into a contract;
• investing; or
• relying on it for an important purpose.

You must comply with the MakerShake Acceptable Use Policy.

Among other things, you must not use MakerShake for:

• phishing;
• malware;
• scams;
• fraud;
• impersonation;
• unlawful goods or services;
• child sexual exploitation;
• non-consensual intimate content;
• unlawful extremist or terrorist content;
• harassment or threats;
• doxxing;
• unlawful surveillance;
• intellectual-property infringement;
• deceptive advertising;
• fake engagement;
• unlawful marketing;
• unauthorized access;
• spam;
• artificial traffic manipulation; or
• other unlawful or prohibited activity.

The Acceptable Use Policy contains the more detailed rules and forms part of these Terms.

You must not:

• interfere with MakerShake's security or operation;
• bypass access, payment, account, rate-limit, or moderation controls;
• scrape substantial parts of MakerShake without authorization;
• harvest contact information;
• create artificial accounts, views, clicks, votes, saves, follows, or messages;
• use bots to submit projects without permission;
• create misleading duplicate profiles;
• impersonate another person;
• claim a project without authorization;
• probe private endpoints;
• exploit vulnerabilities;
• reverse engineer protected parts of the service except where mandatory law permits it; or
• overload MakerShake infrastructure.

Users and third parties may report content they believe to be unlawful or otherwise prohibited.

Reports should include sufficient information to identify and assess the content, such as:

• the relevant profile, comment, message, or URL;
• a description of the issue;
• the right or legal rule allegedly violated;
• supporting information; and
• contact information where appropriate.

Reports must be submitted in good faith. You can use the reporting form.

MakerShake may request additional information where necessary.

Submitting a report does not guarantee removal.

MakerShake may use:

• automated systems;
• manual review;
• user reports;
• trusted information;
• provider signals; and
• other reasonable methods to moderate profiles, content, messages, and accounts.

Automated safety screening of submitted and published websites, including periodic re-screening of live listings, forms part of this moderation. Results are recorded so that decisions can be reviewed by a person, explained, and appealed.

Possible actions include:

• rejecting submissions;
• changing categories or tags;
• requesting corrections;
• reducing visibility;
• excluding a project from featured placement;
• displaying warnings;
• restricting comments or messages;
• unpublishing or deleting content;
• suspending account functionality; or
• terminating an account.

Where required by applicable law, MakerShake will provide information about the reason for certain moderation decisions and available complaint or redress options. The Digital Services Act (Regulation (EU) 2022/2065) establishes statement-of-reasons and redress mechanisms for relevant platform moderation decisions. See also our Moderation Policy.

If you believe a moderation decision was incorrect, you may use the available complaint or appeal mechanism or contact contact@domu.studio.

Your appeal should identify:

• the relevant account or content;
• the decision;
• why you believe it was incorrect; and
• any supporting information.

MakerShake may reject complaints that are abusive, fraudulent, repetitive, or manifestly unfounded.

Where applicable, statutory rights to internal complaint handling, certified out-of-court dispute settlement, or judicial redress remain unaffected. The Digital Services Act provides for out-of-court dispute settlement for qualifying platform disputes.

Paid MakerShake plans and additional project slots may renew automatically for the billing interval displayed at checkout.

By purchasing a recurring subscription, you authorize MakerShake's payment provider to charge the fees and applicable taxes displayed before purchase.

You may cancel your subscription at any time using the available account, billing, or legally required online cancellation flow.

For qualifying consumer subscription contracts concluded through the website, MakerShake provides an online cancellation mechanism in accordance with applicable German law. § 312k BGB requires qualifying consumer subscription contracts entered through a website to support an electronic cancellation process.

Unless otherwise stated, cancellation takes effect at the end of the current paid billing period.

After cancellation:

• paid features generally remain available until the end of the paid period;
• paid visibility then ends;
• analytics may become unavailable;
• additional project slots may be removed;
• excess projects may become unpublished, archived, restricted, or read-only; and
• the account may return to the then-current Free-plan limits.

Where reasonably possible, MakerShake may allow users to choose which project remains active within the Free-plan allowance.

If you are a consumer in the European Union and enter into an eligible distance contract, you generally have a statutory right of withdrawal under applicable consumer law.

Under German law, the standard withdrawal period is generally 14 days, subject to the applicable statutory rules and exceptions (§§ 312g, 355 BGB).

Where required, MakerShake provides:

• withdrawal instructions;
• information about the withdrawal period;
• information concerning any exception or early expiry;
• the legally required withdrawal functionality or form where applicable; and
• other mandatory consumer information.

If you request that a digital service begin during the withdrawal period, the legal consequences depend on the type of service and the statutory requirements. A withdrawal right may expire early only where the requirements of the applicable law (§ 356 BGB) are satisfied.

Nothing in these Terms limits mandatory consumer rights.

MakerShake uses Stripe for payment and subscription processing.

You must provide accurate billing and payment information.

Stripe may process full payment-method information directly. MakerShake generally does not receive complete card numbers or card-security codes.

If a payment:

• fails;
• is rejected;
• is reversed;
• is disputed;
• is charged back; or
• is otherwise not received,

MakerShake may restrict or suspend the associated paid features, subscription, or additional project slots.

Payment processing is also subject to applicable Stripe terms and privacy information.

Mandatory statutory refund rights remain unaffected.

Except where:

• mandatory law requires a refund;
• MakerShake expressly offers a refund;
• checkout information states otherwise; or
• a service was not provided as contractually required,

fees paid for a properly provided service are generally not refundable merely because the user stops using MakerShake before the end of the paid period.

Where MakerShake permanently discontinues a prepaid paid service before the end of the relevant paid period, applicable contractual or statutory refund rights remain unaffected.

Prices may include or exclude VAT or other taxes depending on:

• the displayed price;
• the customer's location;
• tax status; and
• applicable law.

Any taxes payable by the customer will be shown where required before completing the purchase.

Users are responsible for their own tax obligations arising from transactions or arrangements they enter into with other MakerShake users.

MakerShake aims to provide a reliable service but does not guarantee uninterrupted or error-free operation.

Availability may be affected by:

• maintenance;
• technical failures;
• infrastructure providers;
• third-party APIs;
• security incidents;
• abuse prevention;
• service updates;
• legal requirements;
• force majeure; or
• circumstances outside MakerShake's reasonable control.

You should retain your own copies of important project information and uploaded material.

MakerShake does not guarantee:

• publication or continued publication;
• a particular search or ranking position;
• a fixed amount of visibility;
• search-engine indexing;
• AI or LLM visibility;
• social-media distribution;
• views;
• clicks;
• comments;
• followers;
• messages;
• customers;
• users;
• downloads;
• revenue;
• investments;
• fundraising;
• employment;
• contracts;
• successful remixes; or
• any other commercial result.

MakerShake, DOMU.STUDIO, and their original:

• software;
• branding;
• logos;
• website design;
• directory structure;
• database organization;
• original text;
• workflows;
• interface elements; and
• other original materials

are protected by applicable intellectual-property law.

You may not copy, reproduce, resell, sublicense, systematically scrape, reverse engineer, or commercially exploit MakerShake or substantial parts of it without authorization, except where mandatory law permits such activity.

Third-party project names, logos, screenshots, trademarks, and other content remain subject to the rights of their respective owners.

Your use of MakerShake is also governed by the MakerShake Privacy Policy and Cookie Policy.

Those policies explain how personal data and device technologies are processed in connection with:

• accounts;
• project profiles;
• URL generation;
• AI;
• screenshots;
• comments and interactions;
• direct messaging;
• contact forms;
• analytics;
• email;
• payments;
• cookies;
• infrastructure providers; and
• other MakerShake functionality.

MakerShake relies on third-party technical providers.

These may include providers for:

• application infrastructure;
• hosting;
• databases;
• authentication;
• storage;
• payments;
• email;
• analytics;
• AI generation;
• screenshots;
• edge delivery;
• security, threat intelligence, domain-name resolution, and safe-browsing feeds; and
• related functionality.

Third-party services may have their own:

• technical limitations;
• downtime;
• terms;
• privacy practices; and
• availability.

MakerShake is not responsible for failures outside its reasonable control but does not exclude any liability that cannot legally be excluded.

Nothing in these Terms excludes or limits liability where doing so is prohibited by law.

This includes liability for:

• intent;
• gross negligence;
• injury to life, body, or health;
• mandatory product liability; and
• other legally non-excludable liability.

For slight negligence, MakerShake is liable only for breaches of essential contractual obligations.

Essential contractual obligations are obligations whose performance is necessary for the proper performance of the contract and on whose observance the user may ordinarily rely.

Where liability arises from slight negligence in relation to an essential contractual obligation, liability is limited to damage that was typical and reasonably foreseeable when the contract was concluded.

Subject to mandatory law, MakerShake is not responsible for losses caused solely by:

• independent third-party projects;
• third-party websites;
• unlawful User Content;
• inaccurate user-supplied information;
• inaccurate automatically generated profile content;
• decisions of external search engines or social platforms;
• unsuccessful business, employment, investment, collaboration, or remix discussions;
• inaccurate or incomplete analytics; or
• infrastructure failures outside MakerShake's reasonable control.

You may stop using MakerShake at any time.

You may delete or deactivate your account using the functionality provided where available or contact MakerShake if account deletion requires support.

MakerShake may restrict, suspend, or terminate access if:

• you materially violate these Terms;
• you materially violate the Acceptable Use Policy;
• payment is not received;
• content is unlawful;
• content infringes third-party rights;
• you submit fraudulent or deceptive profiles;
• you manipulate engagement or discovery;
• you misuse messages, contact forms, or community features;
• you create a security or fraud risk;
• suspension is required by law; or
• continued access cannot reasonably be maintained for serious technical or operational reasons.

Where required by law, MakerShake will provide prior notice, reasons, an opportunity to remedy, or complaint rights.

After termination, depending on the circumstances:

• project profiles may be removed or unpublished;
• content may be archived;
• disputed profiles may be transferred to an authorized rights holder;
• some public content may remain where legally permitted;
• private account functionality will end; and
• legally required or technically necessary records may be retained.

MakerShake may improve, modify, add, restrict, replace, or discontinue features.

Where changes materially affect an active consumer contract, applicable statutory rights concerning digital products, conformity, price reduction, termination, refund, and notice remain unaffected.

MakerShake will not rely on this clause to deprive consumers of mandatory contractual rights.

MakerShake may update these Terms to reflect:

• changes to MakerShake functionality;
• new community features;
• new paid features;
• changes to pricing or plans;
• changes in law;
• security requirements;
• moderation practices; or
• operational changes.

The current version will be published with an updated “Last updated” date.

Where required by law or contract, MakerShake will:

• provide prior notice;
• obtain consent;
• offer termination rights; or
• provide another required remedy.

Continued use alone does not replace express consent where applicable law requires explicit agreement.

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules.

If you are a consumer, mandatory consumer-protection provisions applicable in your country of habitual residence remain unaffected.

If you are:

• a merchant;
• a legal entity under public law; or
• a special fund under public law,

the courts of Cologne, Germany, have jurisdiction to the extent legally permitted.

For consumers, the applicable statutory jurisdiction rules remain unaffected.

We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.

Where § 36 VSBG applies, businesses maintaining a website or using general terms must clearly inform consumers whether they are willing or obliged to participate in consumer dispute-resolution proceedings.

This consumer dispute-resolution statement is separate from any platform complaint, moderation appeal, or DSA out-of-court redress mechanism that may apply to content-moderation decisions.

If any provision of these Terms is invalid, unlawful, or unenforceable, the remaining provisions remain unaffected.

The applicable statutory provision will apply in place of the invalid provision.

Nothing in this clause is intended to preserve an invalid contractual term beyond what applicable law permits.
